Those charged with an OUI in Northborough will want to call an experienced OUI attorney to help them throughout the process of a drunk driving charge. Northborough OUI attorney Michael Delsignore has tried hundreds of cases originating in Northborough and the surrounding area.
There are two things make an OUI arrest in Northborough unique:
- There should be a cruiser camera video of your arrest with audio and video showing your driving and performance on any field sobriety tests;
- There will also be a very clear booking video showing what occurred at the police station.
In this case, the client was pulled over and charged with operating under the influence of alcohol after allegedly speeding and making numerous marked lane violations, and, the officer wrote in the police report that the defendant was slurring his speech and had blood shot eyes. Because the client was not a legal citizen and his future depended upon the outcome of the charge, Attorney DelSignore immediately went to work and requested that any video evidence in the case be preserved. Because of issues at the police station, the booking video was not produced. However, because the police lost the clients booking tapes, the client had a major advantage at trial. He was ultimately found not guilty of the charge.Northborough Police Arrest Client for OUI 1st Offense: Client Found Not Guilty
In this case, the Northborough Police arrested the defendant after allegedly making marked lane violations and after failing field sobriety tests; the police said that when the defendant got out of the vehicle she was unsteady on her feet and had slurred speech. The booking video we were able to obtain from the Northborough Police Arrest showed that the defendant was not slurring her words nor did she appear to be under the influence of alcohol. After trial, the defendant was found not guilty on the OUI 1st Offense charge.
The cruiser cameras are very rare and will record what the cruiser is looking at. This is a good opportunity for an experienced OUI attorney to set up a defense as this cruiser camera will show how the client drove and performed on the field sobriety tests.
Through thorough research of these tapes and police reports, Attorney Delsignore has had great success in showing that his client did not drive as recklessly as the report indicated and that they actually performed well on the field sobriety test. An experienced OUI attorney will know the process a police officer is supposed to use when administering the field sobriety test. Often times, these tapes can show an error by the officer that made a client perform worse on the test and this can help the defense.
In a Northborough OUI case, there will also be a video of the booking at the police station. This will have video of a client either refusing or taking a breathalyzer and the booking procedure at the station. Much of the tape will be inadmissible like refusing the breathalyzer test. Attorney Delsignore will be able to edit the video by showing his client had good balance, could speak well and all other motor functions were fine.
