Although being stopped at a roadblock can feel like there is no way out, Attorney DelSignore has successfully challenged roadblock cases on the grounds that the stop was not conducted in compliance with the legal requirements that govern how a roadblock must be set up and run.

Following an accident on a poorly lit road, the client was taken to be evaluated by medical personnel, limiting the arresting officer’s interaction with him before the arrest. Attorney DelSignore highlighted a discrepancy in the police report and that the officer never inspected the vehicle to determine whether the airbags had deployed. The client was found not guilty.

The client was found asleep in his car, parked safely, with the engine running. On cross-examination, Attorney DelSignore highlighted what the client did well on the field sobriety exercises and impeached the officer’s scoring of the nine-step walk and turn. The client was found not guilty, avoiding a two-year license loss.

Following a car accident, the client was alleged to have been unsteady on his feet with an odor of alcohol and glassy eyes, and to have failed the nine-step walk-and-turn and one-leg-stand tests. The breath test was excluded from evidence at trial, and the client was found not guilty – keeping his job without any penalty.
