Being arrested for OUI is much different from being convicted. A police officer only needs what the law calls probable cause to make an arrest. That is very little evidence when compared to the high standard to get a conviction in Court, at a trial in front of a jury or judge. The law requires proof beyond a reasonable doubt which means an abiding conviction to a near moral certitude. The Commonwealth has to rule out every reasonable doubt to secure a conviction.
