Massachusetts Board of Appeals: Tips to getting your license back

If you have had your license suspended by the Massachusetts RMV, you know it is a frustrating and difficult process to get it back.  Often, you will need a hearing with the Massachusetts Board of Appeals to get your license back.  This is a three member board that has more discretion to reinstate your license than the RMV.  To get to the Board of Appeals, you must fill out a form and send in a fifty dollar filing fee.   Your hearing will be scheduled in four to six months.  Here are some tips for success before the Board.

  1.  The Board is not simply going to reinstate your license no matter how long you have been without it.
  2. You must address the reason for the suspension; if it is medical, make sure to fill out the RMV medical forms.  There is a medical evaluation form as well as a loss of consciousness form if there is any allegation you lost consciousness or sustained a head injury.
  3. If the suspension is alcohol or drug related, you will need a substance abuse evaluation and if it is drug related proof of negative drug screens for at least three months.
  4. You are more likely to obtain relief if the criminal charge is closed but still may be given a license if the charge is still open.  If the charge is still open and alcohol related, you may be able to get a license with an interlock device.
  5. If your immediate threat is related to alcohol or drugs, you should get treatment and stop drinking or using drugs.  The Board will want proof that you are no longer a threat to your own safety or the public by driving.  Attending AA is looked on very favorably by the Board because it is a way to get help while receiving support at the same time.
  6. Do not deny or try to minimize what happened; the Board wants. you to accept responsibility as it is a sign that you will not reoffend if you acknowledge a problem.
  7. Be polite and respectful and dress appropriately.

It is a long wait to get your license after an OUI accident and immediately threat suspension; keep these points in mind and hiring a lawyer to help you through the process is the best way to ensure you will not be denied your request for reinstatement.
