Suboxone Injuries

Here is a timeline of the development, and status, of the Suboxone tooth decay claims:

  • 2022: After research and reports were found to connect Suboxone sublingual strips with dental issues, the FDA required manufacturers to issue warnings of dental health risks in prescribing information and the patient medication guide.
  • September 28, 2023: The first lawsuit against Indivior was filed in the Northern District of Ohio alleging the sublingual film version of Suboxone led to permanent tooth decay resulting in medical and dental expenses from multiple medical and dental providers.
  • October 30, 2023: A potential antitrust class action lawsuit was filed against Indivior alleging an illegal kickback scheme and false marketing claims.
  • November 1, 2023: Ten new lawsuits alleging negligence against Indivior for its failure to warn consumers of the potential dental health risks had been filed against in federal court within the ten preceding days.
  • November 30, 2023: A group of lawyers acting on behalf of plaintiffs filed a petition with the Judicial Panel on Multijurisdictional Litigation (“JPML”) to consolidate all the federal lawsuits against Indivior into multidistrict litigation (“MDL”) for the purpose of streamlining discovery and pretrial proceedings. The Northern District of Ohio is most likely to be selected as the MDL jurisdiction for the forthcoming Suboxone tooth decay lawsuits.
  • December 26, 2023: The JPML set a hearing for January 25, 2024 in Santa Barbra, California during which arguments will be heard from plaintiffs and defendant Indivior regarding the creation of an MDL for the Suboxone tooth decay lawsuits.
  • January 25, 2024: The JPML will determine whether an MDL jurisdiction will be created and, if so, a jurisdiction will be selected during the hearing.
