{"id":946,"date":"2016-08-19T12:38:17","date_gmt":"2016-08-19T16:38:17","guid":{"rendered":"http:\/\/www.massachusettscriminaldefenselawyerblog.com\/?p=946"},"modified":"2016-08-19T12:38:17","modified_gmt":"2016-08-19T16:38:17","slug":"sjc-rules-aaron-hernandezs-lawyers-must-turn-cell-phone","status":"publish","type":"post","link":"https:\/\/www.delsignoredefense.com\/blog\/sjc-rules-aaron-hernandezs-lawyers-must-turn-cell-phone\/","title":{"rendered":"SJC rules that Aaron Hernandez&#8217;s lawyers must turn over cell phone"},"content":{"rendered":"<p>In a decision that could impact Aaron Harnandez\u2019s upcoming murder trial in February, the Massachusetts Supreme Judicial Court ruled today that his lawyers can be compelled to provide his phone to the Commonwealth pursuant to an anticipatory search warrant.<\/p>\n<p>Interpreting the statute governing search warrants General Laws 276 Section 1, the SJC noted that the statute did not intend to shield from disclosure anything that a criminal defendant provides to a lawyer in all cases.<\/p>\n<p>The Court noted that none of the parties made any claim that there was privileged communications on the cell phone. \u00a0The judge found probable cause to believe that the cell phone would obtain evidence of criminal activity.
