United States Supreme Court May Decide. <\/strong><\/p>\n<p><span data-preserver-spaces=\"true\">In many states, it is legal for two co-defendants in a crime to retain the same attorney. However, this is not the ideal situation because it is ripe for conflicts of interest. Co-defendants in a criminal case likely have information about the other defendant that can be detrimental to their case and will oftentimes \u201cflip\u201d on their codefendant. It can be difficult for an attorney to represent both codefendants competently and diligently as required. The American Bar Association advises against representing co-defendants, but there is no general law forbidding it. The Supreme Court could change this. The case of <\/span><em><span data-preserver-spaces=\"true\"><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21-53\/183041\/20210701152848704_Cert%20Petition.pdf\">Holcombe v. Florida<\/a>\u00a0<\/span><\/em><span data-preserver-spaces=\"true\">is pending before the Supreme Court and asks the Court whether an \u201cactual\u201d conflict of interest that adversely affects counsel\u2019s representation when the attorney engages in \u201cjoint and dual\u201d representation \u2013 i.e., simultaneously representing both the defendant and a key prosecution witness during a trial.\u00a0<\/span><\/p>\n<p><strong><span data-preserver-spaces=\"true\">What happened in\u00a0<\/span><em><span data-preserver-spaces=\"true\">Holcombe v.
