{"id":2658,"date":"2021-02-25T04:45:45","date_gmt":"2021-02-25T09:45:45","guid":{"rendered":"https:\/\/www.delsignoredefense.com\/blog\/?p=2658"},"modified":"2021-02-20T09:46:42","modified_gmt":"2021-02-20T14:46:42","slug":"massachusetts-appeals-court-explains-when-a-failed-breath-test-attempt-can-be-admitted-during-an-oui-trial","status":"publish","type":"post","link":"https:\/\/www.delsignoredefense.com\/blog\/massachusetts-appeals-court-explains-when-a-failed-breath-test-attempt-can-be-admitted-during-an-oui-trial\/","title":{"rendered":"Massachusetts Appeals Court explains when a failed breath test attempt can be admitted during an OUI trial"},"content":{"rendered":"<p>Breath test evidence is heavily contested in Massachusetts OUI trials. \u00a0When someone takes a breath test, as a Massachusetts OUUI Lawyer, we attempt to exclude the results from evidence as being unreliable. \u00a0But what happens if the machine does not register, is the failed attempt to take a breath test admissible and under what circumstances. \u00a0That was the issue in the case of <em><a href=\"https:\/\/www.socialaw.com\/services\/slip-opinions\/slip-opinion-details\/commonwealth-vs.-amy-s.-daigle\">Commonwealth v. Daigle<\/a>, <\/em>the Massachusetts Appellate Court answered this question.<\/p>\n<p>A failed breath test is admissible in certain circumstances. It is well settled that a defendant refusing to take a breath test is not admission against them during an OUI trial. However, if a defendant signs a consent form to take a breath test, a machine malfunction or other errors may be admissible, In the case of <em>Commonwealth v. Curley<\/em>, police officers alleged that the defendant was purposely blowing into a breathalyzer machine incorrectly as to inhibit the machine from producing a reading.
