Hector Rico<\/em>, decided in December of 2020 what the Commonwealth would have to prove to obtain a conviction on this charge. \u00a0The issue before the Court was whether the defendant had to know there was an accident and also have knowledge that someone suffered injury.<\/p>\n<p dir=\"auto\">The Appeals Court found that the Commonwealth must establish the defendant&#8217;s knowledge on both elements of the offense.<\/p>\n<p>The Leaving the Scene Statute states:\u00a0 Whoever operate a motor vehicle upon any way . . .
