Strom<\/em><\/a>, asks the question of whether the \u201ccommunity caretaking\u201d exception to the Fourth Amendment\u2019s warrant requirement extends to the home.<\/p>\n<p><strong>What is \u201ccommunity caretaking?\u201d<\/strong><\/p>\n<p>Community care taking has been recognized as an exception to the Fourth Amendment by the United States Supreme Court. \u00a0In Cady v. Dombrowski, 413 U.S. 433 (1973), the United Starts Supreme Court held that police officers did not violate the Fourth Amendment when they searched the trunk of a car that had been towed after an accident.\u00a0 The Court acknowledged that, \u201cexcept in certain carefully defined classes of cases,\u201d police cannot search private property without consent or a warrant. \u00a0It emphasized, however, that \u201cthere is a constitutional difference between houses and cars.\u201d\u00a0 Since <em>Cady<\/em>, there has been a whole host of cases that took this holding and created the doctrine of \u201ccommunity caretaking.\u201d\u00a0 <em>Cady <\/em>defined community caretaking activities as those \u201ctotally divorced from the detection, investigation, or acquisition of evidence relating to the violation of a criminal statute.\u201d<\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.delsignoredefense.com\/blog\/does-the-community-care-taker-exception-allow-police-to-enter-the-home-without-a-warrant-under-the-4th-amendment\/\"  title=\"Continue Reading Does the Community Care Taker exception allow police to enter the home without a warrant under the 4th Amendment?\" class=\"more-link\">Continue Reading \u203a<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>The Community Care taker Exception to the Fourth Amendment allows police officers to make warrantless search when the purpose of the officer to to help the public and not look for evidence of criminal activity. \u00a0A case pending before the United States Supreme Court, Caniglia v.
