Charles Bohigian<\/em> today holding that a blood draw without the consent of the defendant is inadmissible into evidence.\u00a0 This case arose out of the Westborough District Court and was transferred to Worcester District Court for trial.<\/p>\n<p>The defendant was charged with OUI causing Serious Bodily Injury.<\/p>\n<p>The Massachusetts Supreme Judicial Court stated that it is Constitutional to draw blood without consent as long as an officer has a warrant or exigency circumstances make getting a warrant impractical. \u00a0However,\u00a0the legislature created a statutory framework for getting Blood in the context of an OUI.<\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.delsignoredefense.com\/blog\/massachusetts-sjc-finds-all-involuntary-blood-draws-inadmissible-in-prosecutions-for-oui\/\"  title=\"Continue Reading Massachusetts SJC finds all involuntary blood draws inadmissible in prosecutions for OUI\" class=\"more-link\">Continue Reading \u203a<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>The Massachusetts Supreme Judicial Court decided the case of Commonwealth v.
