{"id":2525,"date":"2021-01-10T05:03:00","date_gmt":"2021-01-10T10:03:00","guid":{"rendered":"https:\/\/www.delsignoredefense.com\/blog\/?p=2525"},"modified":"2021-01-08T23:04:45","modified_gmt":"2021-01-09T04:04:45","slug":"massachusetts-supreme-judicial-court-decides-cell-site-location-information-case","status":"publish","type":"post","link":"https:\/\/www.delsignoredefense.com\/blog\/massachusetts-supreme-judicial-court-decides-cell-site-location-information-case\/","title":{"rendered":"Massachusetts Supreme Judicial Court Decides Cell Site Location Information Case"},"content":{"rendered":"<p>What type of cell phone information can the police obtain without a warrant? \u00a0This is an important question under the 4th amendment that the Massachusetts Supreme Court recently addressed. \u00a0Nowadays, nobody leaves their cell-phones out of their sight, and a cell phone is almost an extension of a person\u2019s body.\u00a0 However, inside of your smartphone are powerful location tracking services, that \u201cping\u201d your location whenever you are near a cell tower.\u00a0 The use of this data in criminal cases is controversial, and many would consider it an invasion of privacy.\u00a0 The Supreme Judicial Court recently decided a murder case involving cell site location information (CSLI) in <a href=\"https:\/\/law.justia.com\/cases\/massachusetts\/supreme-court\/2020\/sjc-12124.html\"><em>Commonwealth v. Wilkerson<\/em><\/a>.<\/p>\n<p><strong>What happened in <em>Wilkerson<\/em>?<\/strong><\/p>\n<p>The victim in this case was twenty-three year old Kristopher Rosa, who was a longtime rival of one of the defendant\u2019s high school friends, Rhandisyn Lawrence.\u00a0 Lawrence and the victim had a rivalry that apparently stemmed from both of them dating the same woman, Mendes, who the victim later had a child with.\u00a0 In 2011, Lawrence and the defendant, Wilkerson, chased Rosa in cars when Rosa and his girlfriend were on the way to his mother\u2019s house.\u00a0 He was shot in the chest while still driving and pronounced dead from a gunshot wound.\u00a0 The defendant was convicted of first degree murder of Rosa two years after the incident, when the defendant\u2019s girlfriend called the police.<\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.delsignoredefense.com\/blog\/massachusetts-supreme-judicial-court-decides-cell-site-location-information-case\/\"  title=\"Continue Reading Massachusetts Supreme Judicial Court Decides Cell Site Location Information Case\" class=\"more-link\">Continue Reading \u203a<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>What type of cell phone information can the police obtain without a warrant?
