How are Massachusetts Domestic Assault and Battery Cases prosecuted without the cooperation of the victim?\u00a0 The case of Commonwealth v. Roy Rand<\/em>, decided by the Massachusetts Appeals Court on June 29, 2020 demonstrates how even\u00a0without the victim testifying, prosecutors in Massachusetts can secure a conviction of domestic assault and battery. \u00a0The key piece of evidence is the 911 call which can come into evidence,\u00a0despite the fact that you\u00a0will not have the opportunity to cross examine the victim if\u00a0the Court defines the call as non-testimonial. \u00a0The Rand<\/em> cases discusses what makes a statement\u00a0admissible under this rule and under the Sixth Amendment to the United States Constitution. \u00a0<\/span><\/p>\n
