Taylor, the court allowed the Commonwealth to essentially get \u201ctwo bites at the apple\u201d when prosecuting a defendant for firearm possession.<\/p>\n<p>The defendant was first charged with \u201ccarrying a loaded firearm.\u201d\u00a0 The charge of \u201ccarrying a loaded firearm,\u201d as written in the statute, requires a predicate offense of either \u201ccarrying a firearm without a license\u201d or \u201cpossession of a machine gun or sawed-off shotgun.\u201d\u00a0 In essence, in order to charge the defendant with the charge of \u201ccarrying a loaded firearm,\u201d the Commonwealth would have first had to charge the defendant with either of the two predicate offenses.<\/p>\n<p>At the close of trial, the defendant argued that he must be found not guilty because the Commonwealth failed to charge him with either of the predicate offenses, and the trial judge granted the motion.<\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.delsignoredefense.com\/blog\/massachusetts-gun-possession-case-results-in-two-prosecutions-despite-double-jeopardy-challenge\/\"  title=\"Continue Reading Massachusetts Gun possession case results in two prosecutions despite double jeopardy challenge\" class=\"more-link\">Continue Reading \u203a<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>In a recent Massachusetts Appeals Court opinion, Commonwealth v.
