{"id":1975,"date":"2019-04-24T05:02:49","date_gmt":"2019-04-24T09:02:49","guid":{"rendered":"https:\/\/www.delsignoredefense.com\/blog\/?p=1975"},"modified":"2019-04-22T10:13:44","modified_gmt":"2019-04-22T14:13:44","slug":"unites-states-supreme-court-review-sought-in-rap-music-case-to-clarify-meaning-of-true-threats-under-the-1st-amendment","status":"publish","type":"post","link":"https:\/\/www.delsignoredefense.com\/blog\/unites-states-supreme-court-review-sought-in-rap-music-case-to-clarify-meaning-of-true-threats-under-the-1st-amendment\/","title":{"rendered":"Unites States Supreme Court Review sought in Rap Music case to clarify meaning of true threats under the 1st Amendment"},"content":{"rendered":"<p>Last August, the Pennsylvania Supreme Court upheld the conviction of Jamal Knox, a rap artist, for multiple charges stemming from what the trial court\u00a0found\u00a0were terroristic threats based on the contents of his rap song \u201cF**ck the Police.\u201d \u00a0Knox petitions for Supreme Court review and if granted, the Court\u00a0could\u00a0not only clarify the \u201ctrue threats\u201d standard \u2013\u00a0a muddledarea of\u00a0First Amendment jurisprudence \u2013 but\u00a0weigh in on the\u00a0culturally-sensitive and\u00a0complicated relationship b<a name=\"m_-6763688685670101233__GoBack\"><\/a>etween rap music\u00a0and free speech.<\/p>\n<p>It\u00a0is well-established law that true threats of violence fall outside of First Amendment protection.\u00a0 What constitutes a \u201ctrue threat,\u201d however, remains far from settled. \u00a0In\u00a0<span class=\"m_-6763688685670101233s4\">Watts v. United States<\/span>,\u00a0304 U.S. 705 (1969),\u00a0the Supreme Court held\u00a0the First Amendment\u00a0does not protect\u00a0statements a reasonable person would regard as threatening. \u00a0In\u00a0<span class=\"m_-6763688685670101233s4\">Virginia v.
