{"id":1856,"date":"2019-01-12T09:58:14","date_gmt":"2019-01-12T14:58:14","guid":{"rendered":"https:\/\/www.delsignoredefense.com\/blog\/?p=1856"},"modified":"2019-01-12T09:58:14","modified_gmt":"2019-01-12T14:58:14","slug":"worcester-district-court-jury-misunderstands-that-verdict-has-to-be-unanimous-massachusetts-appeals-court-declines-to-vacate-conviction","status":"publish","type":"post","link":"https:\/\/www.delsignoredefense.com\/blog\/worcester-district-court-jury-misunderstands-that-verdict-has-to-be-unanimous-massachusetts-appeals-court-declines-to-vacate-conviction\/","title":{"rendered":"Worcester District Court Jury misunderstands that verdict has to be unanimous, Massachusetts Appeals Court declines to vacate conviction"},"content":{"rendered":"<p>In a Massachusetts Criminal Trial, of any type, whether murder or an OUI, the verdict must be unanimous, meaning that all six jurors have to agree whether the verdict is guilty or not guilty.<span class=\"Apple-converted-space\">\u00a0 <\/span>If jurors cannot reach a unanimous verdict, it is called a hung jury and the Commonwealth is permitted to retry the case.<span class=\"Apple-converted-space\">\u00a0 <\/span>The first Bill Cosby trial ended in a hung jury.<span class=\"Apple-converted-space\">\u00a0In every criminal\u00a0<\/span>trial, a jury should be instructed on this principal of law. \u00a0The jury misunderstood this; possibly the instruction should be simplified telling the jury directly that a conviction cannot rest on a vote of five to one or four to two.<\/p>\n<p>In Commonwealth v. Dibenedetto, a trial from the Worcester District Court the jury was under the mistaken belief that only a majority was required to return a verdict.<span class=\"Apple-converted-space\">\u00a0 <\/span>When the judge learned of this after thanking the jurors following the verdict, he instructed them that the verdict must be unanimous.<span class=\"Apple-converted-space\">\u00a0 <\/span>After his reinstruction following the first verdict, the jury then again returned a guilty verdict. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>The Appeals Court held that after the verdict is recorded the verdict is final. After the verdict is rendered, the judge is precluded from inquiring into the propriety of the jurors deliberation or decision making.
