{"id":1670,"date":"2018-08-22T12:44:19","date_gmt":"2018-08-22T16:44:19","guid":{"rendered":"https:\/\/www.delsignoredefense.com\/blog\/?p=1670"},"modified":"2018-08-27T15:11:49","modified_gmt":"2018-08-27T19:11:49","slug":"ananias-litigation-in-massachusetts-could-result-in-old-oui-convictions-or-pleas-with-breath-test-evidence-being-subject-to-motions-to-vacate-the-convictions","status":"publish","type":"post","link":"https:\/\/www.delsignoredefense.com\/blog\/ananias-litigation-in-massachusetts-could-result-in-old-oui-convictions-or-pleas-with-breath-test-evidence-being-subject-to-motions-to-vacate-the-convictions\/","title":{"rendered":"Ananias litigation in Massachusetts could result in Old OUI convictions or pleas with breath test evidence being subject to motions to vacate the convictions"},"content":{"rendered":"<p>Why you may be able to vacate an Old OUI conviction in Massachusetts? \u00a0For the past two years, over 30 DelSignore Law clients have been involved in the breath test litigation in Concord District Court. \u00a0It was a 6:00 meeting with myself and a group of <a href=\"https:\/\/www.delsignoredefense.com\">Massachusetts OUI lawyers<\/a> where we discussed the upcoming litigation regarding the breath test source code. \u00a0At DelSignore Law, we initially joined approximately 30 clients to the litigation who took breath tests. \u00a0As the breath test litigation took additional time, more clients were joined to this statewide litigation.<\/p>\n<p>The litigation took about two years, as every aspect of the machine was tested by the defense. \u00a0Judge Brennan ultimately ruled that the breath test had a reliable source code, that it was specific enough for alcohol and that the partition ratio was scientifically reliable. \u00a0He essentially rejected all of the defenses scientific attacks on the machine. \u00a0However, he made a major ruling that resulted in two years of breath tests being excluded from evidence. \u00a0Those were tests prior to September 14, 2014. \u00a0In his original ruling, the results were only presumptively excluded meaning that the Commonwealth could seek to introduce them.
