O\u2019Leary<\/em> was indicted on an OUI subsequent offense, meaning that it was greater than a Fourth offense.<span class=\"Apple-converted-space\">\u00a0 <\/span>His case involved a common situation that Massachusetts OUI Lawyers encounter.<span class=\"Apple-converted-space\">\u00a0 <\/span>He got into a one car accident and was taken to the hospital. <span class=\"Apple-converted-space\">\u00a0<\/span>When the officer got to the hospital it appeared as though O\u2019leary was intoxicated. \u00a0He admitted to a couple of beers, had bloodshot and glassy eyes as well as slurred speech. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>The officer informed the defendant that he would receive a summons in the mails for OUI.<span class=\"Apple-converted-space\">\u00a0 <\/span>The officer had to seek approval of the report and did not issue the summons until nine days later. <span class=\"Apple-converted-space\">\u00a0This was an important fact that came out at the motion hearing as the motion judge\u00a0found no good reason for the nine day delay. \u00a0<\/span><\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.delsignoredefense.com\/blog\/no-fix-violation-results-in-dismissal-of-massachusetts-oui-charge-out-of-suffolk-country-superior-court\/\"  title=\"Continue Reading No Fix violation results in dismissal of Massachusetts OUI charge out of Suffolk Country Superior Court\" class=\"more-link\">Continue Reading \u203a<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0The Massachusetts Supreme Judicial Court affirmed the dismissal of an OUI charge by a Superior Court judge after the officer did not issue a citation until 9 days after and the defendant did not receive notice until five or six months later. \u00a0 \u00a0\u00a0 \u00a0 The defendant in Commonwealth v.
