{"id":1415,"date":"2017-09-29T12:24:31","date_gmt":"2017-09-29T16:24:31","guid":{"rendered":"https:\/\/www.massachusettscriminaldefenselawyerblog.com\/?p=1415"},"modified":"2017-09-29T12:24:31","modified_gmt":"2017-09-29T16:24:31","slug":"massachusetts-appeals-court-finds-breath-test-admissible-despite-failure-comply-regulations-leary-decision","status":"publish","type":"post","link":"https:\/\/www.delsignoredefense.com\/blog\/massachusetts-appeals-court-finds-breath-test-admissible-despite-failure-comply-regulations-leary-decision\/","title":{"rendered":"Massachusetts Appeals Court finds breath test admissible despite failure to comply with the regulations in Leary decision"},"content":{"rendered":"<p>The Massachusetts Appeals Court ruled today that the breath test operator does not have to watch the defendant to be in compliance with the 15 minutes observation period.\u00a0 This ruling is contrary to the regulations requiring that the breath test operator observe a defendant for 15 minutes.<\/p>\n<p>This decision arose out of a motor vehicle homicide case and is likely to be appealed.\u00a0 The Appeals Court\u2019s decision is contrary to the regulations and disregards the fact that a breath test operator has special training to determine whether someone is under the influence of alcohol.\u00a0 The decision of the Appeals Court is Commonwealth v. Leary.<\/p>\n<p>The burden of the Commonwealth to prove compliance with the 15 minute observation period is not very difficult.\u00a0 A breath test operator should be able to watch the person taking the test for 15 minutes.\u00a0 There are a lot of issues with the reliability of breath test machines that are being litigated as part of the consolidated litigation before Judge Brennan.\u00a0 It was recently revealed that there were serious discovery violations during this litigation.\u00a0 To lessen the requirement of admissibility was an unfortunate decision for the court when the regulation could not be more clear.\u00a0 As a <a href=\"https:\/\/www.delsignoredefense.com\/breathalyzer-defenses.html\">Massachusetts OUI Lawye<\/a>r, this decision can be distinguished; it appears as though the Court may have been making inferences from the video in the case.\u00a0 There is no indication from the opinion what role the other officers had during booking.\u00a0 If this case is affirmed, it can be distinguished based on the facts this decision was based on.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Massachusetts Appeals Court ruled today that the breath test operator does not have to watch the defendant to be in compliance with the 15 minutes observation period.\u00a0 This ruling is contrary to the regulations requiring that the breath test operator observe a defendant for 15 minutes.
